We are the sole owner of information collected on the Site. We collect several types of information from and about Users of the Site, including:

Personal Information:  We may collect PII from you when you complete forms, navigate web pages, and in connection with other activities, services, features, or resources we make available on the Site. PII means any information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. PII does not include publicly available information from government records, deidentified or aggregate information, or information excluded from the scope of any applicable data privacy laws.

Deidentified Information: We may collect deidentified information from you and aggregate information that may not by itself reasonably identify you as the source when you navigate the Site (“Deidentified Information”). Deidentified Information may include: (i) device type, (ii) device operating system, (iii) internet browser type, (iv) internet service provider, (v) referring/exit pages, (vi) date/time stamp, and (vii) clickstream information. We will take reasonable measures to ensure that Deidentified Information we collect is not personally identifiable and may not later be easily used to identify you as required by applicable law.

Children’s Information: We do not offer our services or promote the Site to, nor do we intentionally collect, share, sell, or retain PII from, children who are younger than 18 years of age. If we discover that we have inadvertently collected information from a child under 18 years of age, we will promptly take all reasonable measures to delete such information from our systems.

How We Collect Information

The information we collect depends on what Users do when they visit or utilize the Site. We collect PII and Deidentified Information in various ways, including:

Directly from You: We collect PII when you voluntarily submit PII to us while completing forms, uploading documents or other content, requesting email updates, answering surveys, responding to information requests, entering into transactions, processing contracts, or uploading media on the Site and in connection with other activities, services, features, or resources we make available on the Site. The PII we collect depends on what you do when you visit or utilize the Site or how you choose to communicate with us.

Through Your Use of the Site: We may collect PII and Deidentified Information that your browser automatically transmits when you visit the Site. We may also collect Deidentified Information about how you access and interact with the Site through the use of automated tracking technologies, such as session cookies, persistent cookies, and web beacons.

A cookie is a small data file that is transferred to an internet browser, which enables the Site to remember and customize your subsequent visits. From Third Party Services: We may collect PII or Deidentified Information about you through third parties who provide us services, partner with us, or otherwise act or collect information on our behalf or through our Site. These parties include, for example, payment processing partners, credit reporting agencies, data analytics providers, internet service providers, third-party digital wallet providers, and advertising networks. The privacy practices of these parties may differ from the practices described in this Policy.

From Publicly Available Information: We may collect PII or Deidentified Information about you when such information is publicly visible or accessible through public sources such as social media platforms or blockchains. For example, we may collect information related to your blockchain wallet address or your purchase, sale, or transfer of certain NFTs or other assets through a blockchain, which we may then combine with other PII or Deidentified Information you have provided us.

How We Use Information

We may use Users’ PII for lawful business purposes: (i) as necessary for the performance of our contract with Users, (ii) for our legitimate interests, so long as they are not overridden by Users’ own rights and interests, or (iii) as required by law. These purposes include:

Delivery of the Services: We may use your PII and/or Deidentified Information to perform services on behalf of the business, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of the business or service provider.

Direct Marketing: We may use your PII to send you promotional materials about our services or other topics that we think may be of interest to you. You have the right to opt-out of receiving direct marketing.

 

Short-Term Interactions: We may make short-term, transient use of your PII including, but not limited to, non-personalized advertising shown as part of your then-current interaction with the Site, provided your PII is not disclosed to another third party and is not used to build a profile about you or otherwise alter your experience outside of the then-current interaction with the business.

 

Auditing: We may use your PII to help us conduct audits related to counting ad impressions to unique Users, verifying the positioning and quality of ad impressions, and auditing compliance with applicable data privacy laws and other standards.

 

User Experience Personalization: We may use your PII and/or Deidentified Information in the aggregate to analyze Users’ browsing and usage activities and patterns in order to understand Users’ interests and preferences with respect to the Site and our services. For example, we analyze your activity on the Site, information from your profile, the content you post, the transactions you enter into, and your activities across other third-party websites to help us optimize your experience on the Site, including providing you with personalized advertisements and sponsored or commercial content.

 

Business Optimization: We may use your PII and/or Deidentified Information to improve the content on our web pages, to improve the Site and our services, to customize the content and layout of our web pages, to undertake internal research for technological development, and in managing our everyday business needs. We may also use your feedback to improve the Site and our services. All of this is done with the intention of making the Site more useful for you.

 

Research and Innovation: We may use your PII and/or Deidentified Information to conduct research and innovate, alone or in collaboration with our industry partners, in an effort to advance technology and contribute to areas of public interest.

 

Safety and Security: We may use your PII and/or Deidentified Information to promote the safety and security of the Service, our Users, and other parties. For example, we may use the information to authenticate users, facilitate secure transactions, protect against fraud and abuse, respond to a legal request or claim, conduct audits, and enforce our terms and policies.

We will not collect additional categories of PII or use PII we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Third Party Use of Cookies

Some content or applications, including advertisements and social media widgets, on the Site are served by third-parties, including advertisers, ad networks and servers, social media providers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use the Site or interact with certain “widgets” such as Facebook, Instagram, Twitter, and LinkedIn widgets that allow you to integrate or share content from the Site. The information they collect may be associated with your PII or they may collect information, including PII, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly, as their respective privacy policies will govern such tracking and use of information.

How We Disclose Information

We may disclose any collected information, including PII, to a third party for our legitimate business purposes as described below:

To Our Affiliates: We may disclose your PII to affiliates, including companies within the Archeota group.

 

To Contractors and Service Providers: We may disclose your PII to third party contractors and service providers that assist us in providing user support, communicating with Users, and promoting our services, as well as third party contractors and service providers that provide other services to us relating to our services and/or the Site.

 

To Data Analytics Providers: We may passively disclose your PII to third party internet cookie recipients, such as Wix, Azure, and other similar service providers, that analyze certain information regarding visits to and use of our Site on our behalf. These third parties, among others, provide us with reports on such activities to assist us in operating our business, but may also use the PII collected through the relevant cookies on our Site for its own purposes. For more information on how to opt-out of or otherwise control this type of sharing, please see the “Your Choices” Section below.

 

To Third Party Advertisers & Marketers: We may disclose your PII to third parties to market their products to you or to serve targeted ads to you on our behalf, if you have not opted out of these disclosures. For example, we allow certain third-party providers to use device identifiers or cookies to collect certain information when you visit our Site which is then used to serve ads for our services when you visit our Site or other websites. These parties use Deidentified Information (e.g., clickstream information, browser type, time and date, subject of advertisements clicked or scrolled over, hardware/software information, cookie and session ID) and certain elements of your PII (e.g., static IP address) during your visits to our Site in order to provide targeted advertisements about our goods and services likely to be of greater interest to you. To Partners Who Use Our Analytics Services: We may disclose your Deidentified Information to our partners who engage our analytics services to understand more about how Users are engaging with the Site generally or their content or products specifically. We receive information about how you interact with the Site and its content, as described in this Policy, and then put such information into aggregate reports so that our partners can review and analyze information important to their business needs, including, for example, the general demographics and interests of Users engaging with the Site or their content or products, along with other relevant business information.

 

To Other Users of the Site: We may disclose your PII or Deidentified Information to other Users who offer assets for sale on the Site. For example, when you enter into a transaction or otherwise choose to share information with a seller, creator, prospective purchaser, or other persons on the Site, we may share your PII or Deidentified Information with them and any service providers acting on their behalf in order to complete the transaction, ensure the security of the transaction, and gather any information required by applicable laws or regulations. We may also display or share information related to your publicly viewable activity on the Site or blockchains, including through the use of APIs to make certain information available to other third-party websites and/or applications.

 

To External Researchers: We may disclose your PII or Deidentified Information to external researchers who use such information to conduct market research that advances technology and promotes innovation, safety, security, and integrity of platforms like the Site.

 

To Other Third Parties Approved By You: We may disclose your PII to third parties approved by you, including social media sites and digital wallets you choose to link your account to or third-party payment or transaction processing providers.

 

Law Enforcement, Safety, and Legal Processes: We may disclose your PII to law enforcement or other government officials if it relates to a criminal investigation or alleged criminal activity. We may also disclose your PII: (i) if required or permitted to do so by law; (ii) for fraud protection and credit risk reduction purposes; (iii) in the good-faith belief that such action is necessary to protect our rights, interests, or property; (iv) in the good-faith belief that such action is necessary to protect your safety or the safety of others; or (v) to comply with a judicial proceeding, court order, subpoena, or other similar legal or administrative process.

 

Sale or Acquisition of Assets: If we become involved in a transaction involving the sale of our assets, such as a merger or acquisition, or if we are transferred to another company, we may disclose and/or transfer your PII as part of the transaction. If the surviving entity in that transaction is not us, the surviving company may use your PII pursuant to its own privacy policies, and those policies may be different from this Policy.

 

We will not collect, use, share, or sell your PII to any other third parties or for any other purposes without providing you notice.

Disclaimer Regarding Use of Digital Assets and Blockchains

Any transactions that you make through the Site may be recorded on a public blockchain. Public blockchains are distributed ledgers, intended to immutably record transactions across wide networks of computer systems. Many blockchains are open to forensic analysis which can lead to deanonymization and the unintentional exposure of private financial information, especially when blockchain data is combined with other data. Because blockchains are decentralized or third-party networks which are not controlled or operated by us or our affiliates, we are not able to erase, modify, or alter PII from such networks nor protect any PII related to such transactions from disclosure to third parties.

Security

The security and confidentiality of your PII is very important to us. We use commercially reasonable security measures to protect your PII on the Site. However, no data transmitted over or accessible through the internet can be guaranteed to be 100% secure, especially when stored on blockchains. Given that blockchain technology, smart contracts, and other platforms resting on open-source software are relatively new and constantly evolving, there is always a risk that nefarious groups may attempt to interfere with the blockchain or smart contracts, that the technology may contain intentional or unintentional bugs of weaknesses, or that there may be flaws in programming our source code that open the door for exploitation or abuse of certain information stored on or transferred through the Site. As a result, while we attempt to protect your PII, we cannot guarantee or warrant that your PII will be completely secure (i) from misappropriation by hackers or from other nefarious or criminal activities, or (ii) in the event of a failure of computer hardware, software, blockchain technology, smart contracts, or telecommunications networks.

Data Retention

We will retain Users’ PII while they maintain an account with us or to the extent necessary to provide the services through the Site. Thereafter, we will keep PII for as long as reasonably necessary: (i) to respond to any queries from Users; (ii) to demonstrate we treated Users fairly; (iii) for ordinary business continuity procedures; or (iv) to comply with any applicable laws. Note, however, that we are unable to affirmatively delete PII that was included in a blockchain transaction made through our Site as such PII is made public by engaging in the transaction on a decentralized or third-party network not controlled or operated by us or our affiliates.

Data Privacy Rights

Certain consumer privacy laws and regulations may provide Users from certain geographic areas with additional rights and choices regarding our use of their PII.

Users in California: If you are a resident of California, the California Consumer Privacy Act (“CCPA”) may grant you certain data privacy rights including the right to: (i) request access to, information about, and a copy of your PII we have collected or shared in the previous twelve (12) months in a portable format; (ii) request correction of erasure of PII; and (iii) opt-out of the sale or sharing of your PII to third parties, all without being discriminated against by Company.

Users in European Economic Area or United Kingdom: If you are a User located in the EEA or UK, the European and UK General Data Protection Regulations (“GDPR”) may grant you certain data privacy rights including the right to: (i) request access to and obtain a copy of your PII; (ii) request correction or erasure of PII; (iii) restrict or object to our processing of your PII; (iv) request portability of your PII; and (v) if we have collected and processed your PII with your consent, to withdraw such consent at any time. 

 

Exercising Rights: If you believe that you have such rights under the CCPA, GDPR, or other applicable data protection or privacy laws and wish to exercise them, you may contact us using the Contact Information provided below. You must identify the applicable law and describe the right(s) you wish to exercise with sufficient detail to allow us to process your request. We may ask for additional information to verify your identity or understand your request. We will consider and act upon any request in accordance with applicable law. Please be aware that your rights, if any, are limited to the extent permitted by applicable law.

 

Blockchain Disclaimer: Without limiting the foregoing, please understand that we cannot edit or delete any PII or Deidentified Information that is stored on a blockchain as we do not have custody or control over any blockchains. Any and all PII or Deidentified Information stored on a blockchain, including purchases, sales, and transfers related to your blockchain address and NFTs held at that address, will be considered publicly available information outside of the scope of this Policy.

California's "Shine the Light" Law

California’s “Shine the Light” law permits Users of the Site that are California residents to request certain information regarding our disclosure of PII to third parties for their direct marketing purposes. To make such a request, please contact us at the Contact Information provided below.

Withdraw Consent

Generally, we do not process PII based on consent. However, in the event we do, you have the right to withdraw your consent at any time, without affecting the lawfulness of the processing based on said consent before its withdrawal. Cross Border Data Transfer

To deliver the services through the Site, it may be necessary for us to share your PII outside of your country of residence. We may share PII with our affiliates and service providers located in the United States or any other country where we or our service providers have operations. In the event we transfer PII outside of your country of residence, we will take commercially reasonable measures to ensure the transfer complies with applicable data protection laws and PII is securely transferred. Do Not Track Disclosure

Some internet browsers may transmit “do-not-track” signals to websites with which the browser communicates. The Site does not currently respond to these “do-not-track” signals.

SPAM

We do not participate in bulk email solicitations that you have not consented to receiving (i.e., “Spam”).  We do not sell or disclose customer lists or email address lists to unrelated third parties. Except as otherwise provided herein, we do not share PII with any third-party advertisers.

Third Party Links

The Site may contain links to other websites or applications (“Linked Sites”) that are not owned by Archeota. We do not control the collection or use of any information, including PII, which occurs while you visit Linked Sites. Therefore, we make no representations or warranties for —and will not in any way be liable for—any content, products, services, software, or other materials available on Linked Sites, even if one or more pages of the Linked Site are framed within a page of the Site.

Furthermore, we make no representations or warranties about the privacy policies or practices of the Linked Sites, and Archeota is not responsible for the privacy practices of those Linked Sites. We encourage you to be aware of when you leave the Site and read the privacy policies of Linked Sites.

Modifications

We reserve the right to update this Policy from time-to-time in our sole discretion. If our privacy practices change materially in the future, we will post an updated version of the privacy policy to the Site. It is your responsibility to review this Policy for any changes each time you use the Site. Your use of the Site following the notification of changes to this Policy will constitute your acceptance of such changes. If you do not agree with the changes made, we will honor any opt-out requests made after the Effective Date of a new privacy policy.

Your Choices

General Information Choices: If you ever wish to access, update, change, delete, opt-out of us sharing, otherwise control your PII, or cancel your user account you may do so by making such changes through your user account or contacting us at the Contact Information provided below. To help us process your request, please provide sufficient information to allow us to identify you in our records. We reserve the right to ask for additional information verifying your identity prior to disclosing any PII to you. Should we ask for verification, the information you provide will be used only for verification purposes, and all copies of the information will be destroyed when the process is complete.

Marketing Communications: If you wish to opt-out of receiving update messages and/or direct marketing communications from us, you may opt-out by (i) following any instructions included in the communication, (ii) contacting us at the Contact Information provided below, or (iii) by making such changes through your user account. Please be aware that although you may opt-out of update messages and/or direct marketing communications, we reserve the right to email you administrative notices regarding the Site, as permitted under the CAN-SPAM Act.

Tracking Technologies and Advertising: You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you do not accept browser cookies, however, you may not be able to use all of the Site’s services and functionalities.
